The crime or crimes on Sunday afternoon February 9th, 2003 was started
with a group of youths on BMX bicycles at the Wenatchee Skate Park,
with lots of bad behaviors occurring and turning it in to a hate crime.
Nothing like a slap in the face with crime rizing around the skate park
Not to say - this does make all of the people in Wenatchee that does
ride BMX bicycles look real bad in this town......
Nothing like on your way home from work and seeing a group of TV cams
( the TV news press ) from all over the state of Washington siting around
the Pioneer Park area and pointing there cams at the Wenatchee Skate park
Not to say they where drilling alot of the kids there on what happend on Sunday.
I don`t know what to say - but this I guess,
I am up for all BMX bikes and Skateboards to be at the Wenatchee Skate Park
But in the Skate Park Rules it does say: Bicycles Probhibited!
So - Why are BMX bikers at the Pioneer Park-Skate Park in the first place?
Not to say all the Foul and Abusive Language that if one shows up you will here.
You name it, it is there, the drugs, the smoking and the gang graffiti starting
to show up just like before. Its just sad to see it all turn out this way after so
many people in the Wenatchee area worked hard to get this Skate Park built
for the youth. And Now today the youth has not much RESPECT! for it at all.
Trouble makers are eveywhere in Wenatchee. Yes, I will agree But if one looks
back at some of the history of the Skate Park. Lots of the troubles center in or
around the Wenatchee Skate Park. Now today adding in to the list of Hate Crimes
by a few youths that where at the Skate Park in Pioneer Park armed with a video
cam getting there crime acts all on video tape. - This Should be a wake up call.

My feelings are : "Less get rid of the skate park in all". It has been nothing but
a trouble maker from the start of it in 1997.
What happend on Sunday February 9th, 2003 this crime tops it all now.
Even if the boys that are in trouble are found not guilty, the Wenatchee
Skate Park is a big source of TROUBLES in Wenatchee in all.
A Thought, If the City of Wenatchee would take some time and add a few
internet web cams ( internet cams ) around the skate park area People in
the Wenatchee area could login to the internet and watch there kids at the
skate park from there homes. Some of the crimes may go away with the youth
knowing that big brother is watching them at all times. This is just a thought
but it is something that has not been tride at the skate park area yet.....
Geneb - Gene`s BMX has NOTRHING! to do with this case ( "just the news" )
or having the city of Wenatchee removing the skateboard park. I am one of
the ones that fought to get the skateboard park put in. I just think it needs
to be policed more; if not - then remove it. This case is just one out of a lot
of others that happen at the Wenatchee Skate Park......

An East-mont High School senior who videotaped and encouraged
another teenager`s assault on a jogger will serve 35 days in detention.
At his sentencing hearing Friday, Jacob Kelly O`Hara,17 of East Wenatchee
said he wants to take responsibility for his role in the Feb. 9 attack on
a 42-year-old Wenatchee man. However, O`Hara and his father, Pat O`Hara,
expressed concern that detention will cause him to fall behind in school
and delay his graduation.
"You may end up in summer school," Chelan County Juvenile Court Commissioner
Bart Vandegrift told the youth. He said he doesn`t like forcing young offenders to
miss school, but some cases call for "serious consquences" that will send a message.
As recommended by prosecutors, Vandegrift sentenced O`Hara to five days`
detention for harassment, plus 30 days' detention for complicity to
fourth-degree assault. He also ordered O`Hara to perform 80 hours of
community service and complete one years' probation.
O`Hara and his co-defendant, 16-year-old Mathew D. Clark of Wenatchee,
chased the jogger from Pioneer Park to Miller and Plum streets.
Clark kicked and punched the man, while O`Hara videotaped the scene,
laughing and calling the man names and goading Clark to "get him."
Vandegrift said the beating "was more than likely designed to humiliate the man."
At Clark`s sentencing two weeks ago, Vandegrift charaterized the assault
as a random attack on someone who was going about his daily business.
But O`Hara said he and the victim have a history of conflict.
The man works at a grocery store and once pushed a friend of his
out of the store, O`Hara claimed.
The motive of realiation doesn`t justify the boys' behavior, but
it`s comforting to know that "this was not a pack of wild dogs
attacking the next guy who cam by," Vandegrift said.
A psychological evaluation indicated O`Hara is easily influenced by peers
because of low self-esteem and a need for acceptance, said Tracy Brandt,
O`Hara`s defense attorney.
Clark, described by Chelan County Duputy Prosecutor Ed Stevensen
as "the principal perptrator," was sentenced to 30 days' detention
for harassment, plus 20 to 26 weeks' detention for fourth-degree assault.

Prosecutors allege the teens chased the victim out of a park, then O'Hara
yelled encouragement while he videotaped Clark punching and kicking the man.

"I think you scare a lot of people - not just this particular victim,"
Vandegrift said.
The videotaping of the assault by Clark's co-defendant,
17-year-old Jacob Kelly O'Hara, "made it seem like it was whole
lot of fun for the two of you to do this, which scared people even
more," Vandegrift said. "... I think there was a lot of reaction to
this being just a crime of anarchy."
Clark and O'Hara chased the victim from Pioneer Park to Miller
and Plum streets. Clark punched and kicked the man, while
O'Hara taped and encouraged the violence.
Both Clark and O'Hara pleaded guilty last week. O'Hara is
scheduled for sentencing at 10:30 a.m. April 4.
In Clark's case, Vandegrift followed prosecutors'
recommendation to impose an exceptionally long sentence of 30
days' detention for misdemeanor harassment plus 20 to 26
weeks' detention for fourth-degree assault. Under sentencing
guidelines, Clark's standard range was zero to 60 days.
Clark's mother, Rebecca Little, wanted him sentenced to 51
weeks so he might have a chance of qualifying for juvenile boot
camp and Job Corps programs.
"I'm so embarrassed of what he did - his behavior," Little said.
Vandegrift said he wouldn't grant Little's request unless Clark
agreed to it.
Clark burst into sobs, saying, "I don't know what to do." During a
brief recess to let him think it over, he expressed doubt that he
could stay out of trouble long enough to make it into boot camp.
When the hearing reconvened, court-appointed defense attorney
Renee Hampson said Clark wanted to go with the prosecutors'
recommendation.

Boys Plead Guilty To Reduced Charges In
Jogger Attack - Weak' Case for hate crime
Wenatchee, Washington - 03/15/2003
Two teenagers have pleaded guilty to reduced charges
in connection with a Feb 9 videotape beating of a jogger.
In plea bargains, prosecutors agreed to drop felony charges of
malicious harassment originally filed under Washington`s hate-crime law.
Based on additional information from police reports,
Chelan County Deputy Prossecutor Ed Stevensen said
he felt the case for malicious harassment "was weak"
Originally, prosecutors alleged the boys were motivated by
perceptions that the victim was homosexual or mentally disabled.
The victim denied being either, Stevensen said.
He said other information from the investgation indicates
"an ongoing conflict between the victim and the BMX bike crowd."
Jacob Kelly O'Hara, 17, of East Wenatchee, pleaaded guilty Friday
in Chelan County Juvenile Court to harassment and complicity to
fourth-degree assault. Both offenses are gross misdemeanors.
On Thurdsday, co-defendant Mathew D. Little, 16, of Wenatchee,
entered a modified guilty plea to misdemeanors charges of harassment
and fourth-degree assault.
The boys chased the 42-year old victim from Pioneer Park,
where they had been performing and videotaping stunts on
BMX bikes, to Miller and Plum streets.
O'Hara called the man names that included disparaging terms
for homosexuals, according to Stevensen.
Clark punched and kicked the jogger while O'Hara videtaped
and encouragrd the violence, yelling for Clark to "get him."
Clark, who was on probation for felony convictions when he
attacked the man, will be sentenced at 1:45 p.m. Thursday.
Prosecutors are recommending that he serve 30 days' detention
for harassment, plus to 20-26 weeks'detention for assault.
O'Hara`s sentencing will be at 10:30 a.m. April 4. In his case,
Prosecutors are calling for five days' detention for harassment,
plus 30 days for complicity to assault.

One Teen Arraigned In Jogger Assault

An East Wenatchee teenager accused of videotaping the Feb. 9
beating of a jogger and egging on the attacker pleaded not guilty
at his arraignment Tuesday in Chelan County Juvenile Court.
Jacob Kelly O'Hara, 17, is charged with complicity to malicious
harassment - commonly known as a hate crime - and complicity
to fourth-degree assault.
He and his co-defendant, 16-year-old Mathew D. Clark of
Wenatchee, are suspected of targeting the victim based on
perceptions concerning the man's sexual orientation and mental
capacity, authorities say.
Clark will be arraigned at 10:45 a.m. Thursday on charges of
malicious harassment - also known as a hate crime - and
fourth-degree assault.
The victim, a 42-year-old Wenatchee man who had been running
at Pioneer Park when the boys allegedly chased him down,
suffered scrapes and bruises.
O'Hara and Clark are scheduled to stand trial at 1:30 p.m. March 27.
Malicious harassment is a class "C" felony and fourth-degree
assault a gross misdemeanor. The same goes for complicity to those crimes.

Two teenagers accused of assaulting a jogger and
videotaping the Feb. 9 attack have been charged, as juveniles,
with felonies under Washington's hate-crimes law.
Chelan County Deputy Prosecutor Ed Stevensen said the
suspects called the victim a name implying he was homosexual.
They are also suspected of targeting the 42-year-old man based
on a perception that he was developmentally disabled,
Stevensen said.
One suspect, 16-year-old Mathew D. Clark of Wenatchee, will be
arraigned at 10:45 a.m. Thursday in Chelan County Juvenile
Court on charges of malicious harassment and fourth-degree assault.
Co-defendant Jacob Kelly O'Hara, 17, of East Wenatchee is
charged with complicity to both malicious harassment and
fourth-degree assault. His arraignment is set for 9:45 a.m.
Tuesday. Both were charged Feb. 12.
Clark is alleged to have kicked and punched the jogger while
O'Hara videotaped the beating at Miller and Plum streets at
about 3:30 p.m. Feb. 9. The boys earlier had chased the runner
on bicycles from Pioneer Park and overtaken him when he
tripped while turning onto Plum Street, authorities said.
The man suffered scrapes and bruises but was not hospitalized.
Even if the boys were wrong in their perceptions about the man's
sexual orientation or mental capacity, they can still be convicted
of malicious harassment if the state proves they acted on those
beliefs, Stevensen said.
"We just see them calling this man a certain name and going
after him," he said.
Malicious harassment may be an assault, property crime or
threat made based on perceptions about a victim's race,
ancestry, national origin, sexual orientation or mental, physical
or sensory handicap.
The offense is a class "C" felony that carries an adult penalty of
up to five years in prison and a $10,000 fine. The standard
sentencing range for juveniles is up to 30 days' detention, one
year of community supervision and 150 hours of community service.

The chase down Miller Street lasted about two minutes,

Stevensen said the tape also shows the 17-year-old encouraging
the 16-year-old to attack the man both before and during the
assault, which occurred at 3:30 p.m. He said, based on the tape,
it appears the blows the 16-year-old delivered to the victim's
face and abdomen were not intended to seriously hurt him. He
suffered scrapes and bruises but was not hospitalized.
"It would appear that he was just bullying him, much like a big
kid on a little kid," Stevensen said.
Chelan County Juvenile Court Commissioner Bart Vandegrift on
Monday ordered both youths held on bail, the 16-year-old on
$2,500 and the 17-year-old on $1,500.
The judge found probable cause for charging the 16-year-old
with fourth-degree assault and malicious mischief, both
misdemeanors, as well as a felony count of malicious
harassment. He also found probable cause for charging the
17-year-old as an accomplice to the same crimes. Prosecutors
have not yet pressed charges.
Malicious harassment, commonly known as a "hate crime" law, is
used in cases where an attack is based on the victim's perceived
race, gender or sexual orientation, or a physical or mental disability.
Both youths have criminal records. The 16-year-old has 10
convictions in Washington, mainly in Snohomish County. None
was a violent offense. Last October, he was sentenced to 30
days' detention for possession of stolen property and trespassing.
The 17-year-old was convicted last July in Douglas County
District Court of third-degree malicious mischief and possession
of fireworks. He also has a conviction in Chelan County Juvenile
Court for third-degree theft.
Stevensen said because of the 16-year-old's prior record, he
may seek to try the him as an adult. If so, the boy could face
more than two years in prison.
The Wenatchee World does not routinely identify juveniles in
criminal cases until they are convicted, but may identify them in
high-profile crimes once they are charged.

Teens Attack Jogger, Videotape Beating
Wenatchee, Washington - 02/10/2003
Two juveniles allegedly assaulted a 42-year-old
jogger Sunday afternoon and videotaped the attack.
Wenatchee Police Sgt. Cherie Smith said the two boys, ages
16 and 17, began chasing the man on bikes as he jogged down
Miller Street at around 3:30 p.m. The victim tried to outrun
them, she said, but tripped on a curb as he was turning on to
Plum Street.
Smith said the tape, made by one of the boys, showed the man
on the ground and the other boy slapping him in the face,
kicking him and punching him in the stomach and back.
Police seized the tape as evidence.
Smith said the boys shouted profanities and insults at the victim
as he was beaten. The man suffered scrapes and bruises, but
was not hospitalized.
A passerby reported the attack to police. Two officers arrived on
the scene and found the victim on the ground. The youths were
leaving the scene on their bicycles, and were arrested on
suspicion of fourth-degree assault and booked at the Chelan
County Juvenile Center. Police did not identify the juveniles.

The two young people who allegedly attacked the jogger need
to be made an example of. They definitely need to be charged
under Washington's hate crimes law.
This is Wenatchee. None of us should have to be afraid of walking
on the streets. If we let this go with a slap on the hand, what kind
of message are we sending these young wannabe gangsters that
would premeditate an attack on someone and videotape it?

The problem boils down to the haves and have nots. Lack of attention and the
symbols of status lead young ones down a path with similar others to gain
self esteem thru theft or intimidation, and the blurring effects of drugs or
and alcohol justify this behavior. This is not a new problem - just a growing one.
Parents need to know there are responsibilities that come with children
- there is no free lunch. A parent must spend the time and money to make
a kid a socially responsible with an opportunity to succeed and gain self
esteem. When a parent fails the costs to themselves and society are
much greater.
It was this group of kids who were intimidating unescorted kids at the old
SeaTac track, whose unruly behavior got them expelled from the community
center, and who in response, torched the building and two containers at the
track. This sort of behavior is a black eye for the city authorities, who
are unable to solved the problem. This is a form of terrorism and it should
be attacked the same way , and the perpetrators punished. They don't want
to see this problem in the malls. Bad for business - the oil of politics.
I have met the best of parents in BMX - dedicated to their kid and enjoying
the journey. A successful responsible kid is the greatest joy a parent can
find - to bad it takes 20 years

I would bet the bad people were there before and after a skatepark. Maybe
the police just need to add some concentration on the area and keep it
clean. If it is like most problem areas it is a few that ruin it for many.
Unless all the people using the area are bad it's ashame to take it away.
I suppose if they do tear it down the bad people can move on to a mall or
something. Will they then remove the mall?

at my church's skatepark in jacksonville, we had an awesome summer in 99,
but after two gangs battled there the skatepark program never recovered
from it. hopefully things turn out for the better with the wenatchee deal.

The skateparks are a real asset to the community. The kids need a place to
skate or ride off the street. The problem is with a large number of kids
who have not been properly socialized. They exhibit dangerous, destructive,
and gang related behavior. It's poor or non existent parenting and have
little respect for authority or others property. The sad fact is that this
happens in a town like Wenatchee. The race tracks have the same problem
when the supervision is absent.

GET RID OF THE PARK ????
The park is not the problem. As usual it's People who are the problem!!!
If you get rid of the park and keep the people, you still have the problem.

Obviously there are some wonderful people who hang at this park.
These are probably the type the authorities like to keep tabs on.
If the park is their place to congregate, that is good for the cops.
They know where to find them.
It's bad for us because we have to be around them, tolerate their
presence and falsely be accused of associating with these beautiful people.
They make us and our sport look bad!!
I think the web cam deal is good. If these fools knew they were being
watched, they would most likely behave to a larger degree or leave.
If they stick around and get slapped for being out of line,
they might grow to become better individuals.
If they decide to leave and conduct business as usual,
at least they wont be dragging the rest of us down with them!!!
Although if they leave the authorities might have a tougher time keeping
tabs on them. Maybe that is why you get no support from the local govt.

This behavior sounds very similar to the problems at the SkatePark in
Puyallup just a few weeks ago... Stories are circulating about similar
behaviors at Tacoma and Seattle skateparks as well..... Rumors of the
same behaviors occurring elsewhere are surfacing weekly.....
Who is expected to maintain order in unsupervised skateparks that draw
a rather aggressive clientele......? Are all these skateparks in public
facilities, and are there park rangers or officers like they have at
McCollum Park in Snohomish County...?
Just wondering where it is all headed, and which part of our governmental
structure felt building these parks was a good idea, and when they will
stand up to supervise their better idea for kids........

I don't think it's fair for anyone associated with BMX to lose privileges to
city parks because of a couple of punks causing trouble. BMXers have such
a bad rap without idiots like these guys pulling this kind of crap.
My son who is seven is just starting up his second year of BMX racing and
he looks up to the older kids. Maybe somebody needs to do the same to these
guys and set an example? I just hate to see collective group of people suffer

This behavior is unacceptable!!
To think that this kind of garbage is linked to BMX makes me sick.
These idiots deserve a good thrashing! Sounds like a couple poor
deprived little jerks whose mommy and or daddy can't afford a park
bike and a friggen video cam.
The local bmx community should cut these fools off!!! Maybe a little
discipline will make a difference!! 2 extended vacations at juvenile
hall sounds like a good start. Say goodbye to the bikes, give them to
some kids that deserve them and will do their best to promote riding,
by being concerned about not giving the sport and the people a bad name.
Give these fools lots of probation including no riding at the park.
If you don't teach them now they'll probably continue to do crap
like this! You might as well fill the bowls at your park with dirt right
now! Sorry you poor FOOLS!, think before you act.
There are consequences for every act, good or bad.
Even if you're sorry you still have to PAY!!! Had to vent. Sorry,
